Viele Menschen sind sich nicht sicher, ob sie sich vielleicht strafbar machen, wenn sie einem "Illegalen" helfen. Dass Menschen ohne Papiere in Deutschland auch Rechte haben und es nicht verboten ist einem Menschen zu helfen, ist vielen nicht klar. Hier sind ein paar Stichpunkte und Information zu dem Thema.
Papierlos heißt nicht rechtlos
- Medizinische Behandlung und andere humanitäre Hilfen sind nicht strafbar
- Auch Papierlose haben Anspruch auf Leistungen des Sozialamtes
- Wenn sich ein Papierloser selbst an das Sozialamt oder eine andere öffentliche Stelle wendet, hat diese aber eine Meldepflicht
- Nur öffentliche Stellen haben eine Meldepflicht
- Arztpraxen und Krankenhäuser in freier oder privater Trägerschaft sind keine öffentlichen Stellen
- Ärzte und andere Personen, die der Schweigepflicht unterliegen, sind immer – auch in öffentlichen Krankenhäusern – an die Schweigepflicht gebunden
- Auch öffentliche Stellen haben keine Meldeerlaubnis, wenn sie die fragilen Daten von einer Person, die der Schweigepflicht unterliegt, erhalten haben (sollten aber auf die Vertraulichkeit der Daten hingewiesen werden).
Darf man auch ganz privat helfen?
Sie dürfen Ausländer nicht über die Grenze hereinschmuggeln, dabei helfen oder dazu raten. Zu Zeiten des kalten Krieges und der DDR hieß das zwar noch „Fluchthilfe” und war steuer-lich absetzbar, inzwischen ist es aber tatsächlich verboten und heißt „Schleuserkriminalität”. Ansonsten aber gilt: HELFEN ERLAUBT!
-> Wir müssen in Deutschland niemanden denunzieren, abweisen oder wegschauen, wenn er unsere Hilfe braucht, nur weil er keine Aufenthaltsgenehmigung hat.
Privatpersonen, Geschäftsleute und Dienstleister müssen nach Papieren gar nicht fragen. Auch die Gewährung von Kost und Unterkunft im Bereich der privaten Nothilfe/Nächstenliebe ist im Allgemeinen nicht strafbar. Der Gesetzgeber hat 2007 die unentgeltliche „Beihilfe zum unerlaubten Aufenthalt” als qualifizierten Straftatbestand aus dem Ausländergesetz gestrichen, um die Verunsicherung bei privaten Helfern, Kirchen und Ärzteschaft zu beenden (siehe oben). Es bleibt dennoch das Rechtskonstrukt einer Beihilfe nach § 27 StGB möglich. Eine generelle Kriminalisierung sog. klassischer Helferfälle mit dieser Methode ist aber kaum zu befürchten, denn eine Kriminalisierung rein humanitärer Hilfe ist vom Gesetzgeber ausdrücklich nicht gewollt.
Grundsätzlich empfiehlt sich bei humanitärer Hilfe für Papierlose:
- Nicht bei der Einreise helfen
- Nicht zum unerlaubten Verbleib in Deutschland auffordern oder darin bestärken
- Papierlose nicht für sich arbeiten lassen oder ihnen Arbeit vermitteln. Auch unbezahlte Arbeit kann eine illegale Beschäftigung darstellen
Für Ärzte gilt:
- Ärzte haben keine Meldepflicht!
- Ärzte machen sich nicht strafbar, wenn sie Papierlose behandeln
- Ärzte haben die Pflicht, medizinische Hilfe zu leisten. Die Unterlassung kann strafbar sein
